REGULATORY GOVERNANCE IN INDONESIA

(THE STUDY OF CORRUPTION CRIMES CASE)*

INTRODUCTION

The use of regulation as an instrument to reach economic and social policy objectives has increased dramatically since 1940s. Regulation of private behavior has developed as a fundamental tool of government in managing more complex and diverse societes and allowing competing interest to be balanced through a flexible instrument (World Bank Report, 2009)

In recent decades, governments throughout the world have chosen to abandon monopoly supply of utility services. The introduction of competition is to create an environment in which consumers benefit in the form of increased value for money for existing products and services, and in the form of new technologies being marketed more quickly as compared with monopoly supply. Despite the antisipated benefits, it is widely acknowledge that competition, while in its infancy, is subject to severe limitations. This understanding stems, in essence, from the well-established theory of market failure, where markets are considered to ‘fail’ to achieve the most efficient outcome. (Dassler Thoralf, 2004)

In 2005, Indonesia ranked first as the most corrupt nation in Asia according to the Pacific Economic and Risk Consultancy data. Corruption is a daily reality at almost every level and aspect of public life – from Building Permit processing, procurement projects at government agencies, to the law enforcement process.

Corruption grew undetected out of what is considered by the general public to be common aqnd natural practices, such as giving gifts to state officials/ employees or their family members in return for a service rendered. This practice is considered reasonable to do as part of the Eastern culture. These corrupt habits eventually will grow into actual seeds of corruption. [Read the rest of this entry...]
